Fokvs is a study network accessible via web and mobile devices, focused on promoting collaborative learning among students. To use Fokvs, you must read and agree to the Terms of Use and Privacy Policy.

PARTIES
1. By accepting these Terms of Use and accessing our website or app, you, an individual natural person, identified and previously registered on the Fokvs platform, hereinafter referred to as “User,” are entering into agreement with BRUNO KALIL MEDEIROS TECNOLOGIA DA INFORMACAO LTDA, a private legal entity registered under CNPJ/ME No. 50.887.154/0001-15, hereinafter referred to as “Fokvs.”
DEFINITIONS
- Access: The User’s action of using the Fokvs platform by browsing, viewing, or interacting with available content and services.
- Account: Credentials required to access restricted areas and use platform features, consisting of a personal and non-transferable login and password.
- Sharing: The act of allowing third parties to access content hosted by the User on the Fokvs platform.
- Content: Study files posted by the User on the platform, including summaries, lecture notes, exams, academic papers, and other related materials.
- Personal Data: Information that identifies or can identify a natural person, such as name, address, email, phone number, etc.
- Students: All registered Users who use the platform’s services and content for educational purposes.
- Gamification: Points system based on User interactions on the platform, including activities such as content uploads, participation in discussions, and other engagement forms.
- Hosting: Storage of User content on the Fokvs platform, ensuring its availability for access and sharing.
- Applicable Intellectual Property Legislation: Brazilian laws governing intellectual property, including copyrights, trademarks, patents, and related rights.
- Partners: Commercial entities, natural or legal persons, collaborating with Fokvs in offering services, technical support, or other platform-related activities.
- Content Creator: User who uploads and shares study materials on the platform, contributing resources accessible to other Users.
- Monetized Materials: Files that, after Fokvs evaluation, are eligible to generate revenue per view, unlocked by credits and yielding earnings for the creator per valid view.
- Fokvs Platform: Online interface and mobile app of Fokvs where Users can access content, interact, and use offered services.
- User: Person registered on the Fokvs platform who can interact with content, share materials, and use available services.
ACCEPTANCE OF TERMS OF USE
1. Responsibility for Use: By using Fokvs, you are responsible for compliance with all applicable Brazilian laws and Fokvs’s policies, including proper conduct, respect for third-party rights, and responsible use of platform features.
2. Minors: If you are under 18, your parents or legal guardians assume all obligations and responsibilities herein. Minors must obtain parental consent before registering and using the platform.
3. Non-Transferable Registration: Your Fokvs account is individual and non-transferable. Do not share your credentials; you are responsible for keeping them secure.
SUPPORT AND SERVICE
1. Support Services: Fokvs provides free support accessible via the contact email on the platform, covering technical issues, usage questions, and related service inquiries.
2. Support Limitations: Support does not cover system or equipment configurations unrelated to Fokvs, such as personal computer setups, home networks, or mobile device settings not impacting platform operation.
PLATFORM REGISTRATION
1. Personal Data: You must provide accurate and complete information when registering. Fokvs may cancel accounts with incorrect or incomplete data and is not liable for issues arising from erroneous information.
2. Identity Verification: Fokvs may verify provided information through documents or other means to ensure platform security and integrity.
3. Communications: By registering, you agree to receive communications from Fokvs and its partners (emails, SMS, in-app notifications) about updates, promotions, and other relevant matters.
4. Inappropriate Content and Profiles: Accounts with offensive or unauthorized content may be canceled or removed. Fokvs reserves the right to remove content and profiles violating Terms or Policies.
FOKVS’S OBLIGATIONS
1. Fokvs’s Commitments:
  - Storage Space: Provide server space to store User accounts and content.
  - Continuous Connection: Maintain platform availability, except during scheduled maintenance, technical issues, or force majeure.
  - Technical Support: Offer qualified support for platform-related problems.
  - Service Interruptions: Notify Users in advance when possible of maintenance or unplanned service outages.
2. Limitation of Liability: Fokvs is not liable for damages caused by service interruptions beyond its control (power failures, internet provider issues, etc.).
USER’S OBLIGATIONS AND RESPONSIBILITIES
1. User Statements:
  - Agreement to Terms: You declare that you have read and agree to these Terms and the Fokvs Privacy Policy.
  - Responsible Use: You commit not to post illegal or unauthorized content, to behave respectfully, and not to collect data from other Users without permission.
  - Account Security: You are solely responsible for safeguarding your login credentials and preventing unauthorized access.
2. Account Use Liability: You must take precautions against unauthorized use; Fokvs is not liable for losses from credential negligence.
3. Prohibition of Commercial Exploitation: Platform services are for personal use only; commercial resale or exploitation is prohibited.
DURATION AND TERMINATION
1. Effective Date: These Terms take effect upon your registration date.
2. Termination Conditions:
  - Non-compliance with any provision.
  - Actions harming Fokvs’s image or partners.
  - Illegal activities or Privacy Policy breaches.
  - Unpaid fees for contracted services.
  - Account inactivity for over 6 months.
3. Outstanding Balances: Both parties must settle any debts upon termination.
4. Data Deletion: Fokvs may delete User data post-termination, except as legally required.
5. Future Access Denial: Fokvs may bar future registration by Users previously terminated for violations.
FEATURE CHANGES
1. Improvements and Testing: Fokvs may test new features, resulting in varied User experiences during trials.
2. Third-Party Services: Fokvs may integrate third-party technologies (e.g., clicktracking) if they do not expose personal data.
3. Surveys: Users may be invited to participate in optional research surveys.
4. New Features: All new features remain subject to these Terms and Privacy Policy.
TERM UPDATES
1. Notification of Updates: Fokvs may revise these Terms periodically and will notify Users via email, SMS, WhatsApp, or in-app messages. Continued use implies acceptance of changes.
GENERAL PROVISIONS
1. Entire Agreement: These Terms and the Privacy Policy constitute the complete agreement, replacing prior agreements.
2. Independent Contractors: Parties are independent; no joint venture, franchise, or agency is created.
3. Tolerance and Waiver: Non-exercise of any right does not constitute waiver.
4. Account Suspension: Fokvs may suspend or close accounts upon fraud or violation suspicion.
5. Service Modifications: Fokvs can modify or discontinue services at any time without notice.
6. Severability: Invalid clauses do not affect remaining provisions.
7. Governing Law: The courts of Porto Alegre, Brazil, have jurisdiction over disputes, unless otherwise required by law.
PRODUCT AND SERVICE USE
1. Service Offering: Fokvs, directly or through partners, provides platform services and content hosting.
2. Content Sharing: Users may share content per these Terms and the Privacy Policy and must ensure it is lawful and accurate.
3. Content Access: Access to others’ content may be restricted; Fokvs may offer trial access to encourage engagement.
4. Technical Requirements: Users must have compatible equipment and internet; performance depends on connection quality.
5. Simultaneous Access: Web and mobile access is allowed; concurrent sessions may be blocked for security.
USER-GENERATED CONTENT
1. Usage Permission: By sharing content, Users grant Fokvs the right to edit and publish it under platform policies.
2. Content Liability: Users hold Fokvs harmless for content-related claims and legal costs.
3. Prohibited Content: Educational-only content is allowed; offensive, illegal, or infringing material will be removed without notice.
4. Reporting Policy: Users can report inappropriate content; Fokvs will investigate and take action, including removal or suspension.
INTELLECTUAL PROPERTY
1. Ownership Rights: Fokvs owns platform IP, except User-posted content, including text, icons, software, and design elements.
2. Respect for Rights: Users must not infringe Fokvs’s or third-party IP; duplicates may be linked instead of stored twice.
3. Indemnification: Users indemnify Fokvs for IP infringement damages, including legal fees.
CREDIT SYSTEM
1. Earning Credits: Users earn credits by uploading study materials, which can unlock monetized content and encourage quality contributions.
2. Material Classification: Fokvs classifies User content by educational relevance using internal criteria.
3. Unlocking Monetized Content: Approved materials require credits to unlock; uploading earns credits and fosters continued contributions.
AMBASSADOR PROGRAM
1. Participation: Content Creators in the Ambassador Program earn rewards for valid uploads and views, incentivizing high-quality educational material.
2. Submission Rules: Materials must follow platform rules on originality, copyrights, and educational relevance.
3. Evaluation & Monetization: Fokvs manually reviews submissions and selects materials for monetization based on educational value.
4. View-Based Rewards: Monetized materials generate rewards per valid view by non-creators without manipulation.
5. Prohibition of Fake Views: Attempted manipulation results in program removal and account suspension.
6. Balance & Withdrawal: Earned rewards accumulate in the Creator’s account and can be withdrawn per payment policies.
7. Upload Milestones: Additional rewards for hitting upload milestones, encouraging ongoing contributions.
8. Reward Information: Current reward values for views and milestones are shown in the Ambassador Dashboard.
CREDIT PURCHASE
1. Availability: Credits for unlocking monetized content are purchasable only via the mobile app through the App Store and Play Store, allowing support for Content Creators.
MONTHLY SUBSCRIPTION
1. Unlimited Access: A monthly subscription grants unlimited access to monetized content without needing individual credits, offering a comprehensive learning experience.
2. Subscription Benefits: May include exclusive events, early access to new content, and priority support to enhance User value.
3. Cancellation: Subscribers can cancel anytime in the mobile app settings; access remains until the end of the paid period.
